USHPA E-Mail Policy

The USHPA e-mail you receive is sent specifically to you because you indicated this address on your Membership Application/Renewal Form. As a membership organization, USHPA frequently sends messages to the membership via e-mail as a way to expedite getting information out to the membership.

Specifically, these kinds of messages cover official Association business such as announcements about key events or initiatives, messages from the Association leadership, office, regional directors, and/or candidates for regional director. The Association apologizes if you feel you have received this email in error, or feel it is somehow "spam". Email is the most efficient and effective method of reaching the majority of the USHPA Membership. We understand that some members may not wish to receive these communications, considering them to be "spam". USHPA policy is to strictly enforce the provisions of the Federal CAN-SPAM Act (see below) and we will promptly honor any removal requests.

Our policy is also to strictly enforce abuse of our system, therefore we encourage you to contact us at [email protected] to report receipt of any non-Association-business-related messages. It is important to us that emails you receive from the Association comply with our standing policy. If you wish to report any violations of our policy, please provide full details of the violation and if possible, attach copies of any communications so that we may act on them as soon as possible.

The Association recommends that you log in to the USHPA Members Only area and review your E-Mail and Privacy Preferences if you are concerned about the e-mail you may receive from USHPA. Once you have logged in,  select "Update My Info" and you'll see the checkboxes for each option.

The Association also recommends that you have a valid e-mail address on file so you can receive information from the Association and access the Members Only area of the website. If you don't want any communication from the Association via e-mail, then simply select the appropriate options in "Update My Info".

CAN-SPAM Act 
Requirements and USHPA's Compliance Measures

The 108th Congress set forth in the CAN-SPAM Act (15 U.S.C. 7701-7713, signed into law on December 16, 2003 and effective after January 1, 2004) certain acts and practices that are unlawful in connection with the transmission of commercial email messages.

While USHPA isn't in the business of transmitting commercial email messages, the non-commercial traffic that the Association sends adheres to the same level of compliance.

The provisions of the CAN-SPAM Act and USHPA's compliance measures are as follows:

15 U.S.C. 7704(a)(1) - The Act prohibits transmission of any email that contains false or misleading header or from line information, and clarifies that a header will be considered materially misleading if it fails to identify accurately the computer used to initiate the message because the person initiating the message knowingly uses another protected computer to relay or retransmit the message in order to disguise its origin.

All USHPA emails have valid "From" address fields, and the header information clearly indicates where the email comes from. All emails are sent using a nationally-recognized reputable email management service. 

15 U.S.C. 7704(a)(2) - The Act prohibits false or misleading subject headings.

All USHPA emails have very descriptive subject lines, noting that the message is from the USHPA and what the overall subject of the message pertains to.

15 U.S.C. 7704(a)(3) - The Act requires a functioning return email address or similar Internet-based mechanism for recipients to use to opt-out of receiving future commercial email messages.

USHPA emails are non-commercial in nature and have valid "Reply-To" addresses. To opt out, members must log on to the USHPA Members Only area at ushpa.aero and deselect the appropriate checkboxes. Members not able to log into Members Only need to contact the USHPA office, either by sending a note to [email protected] or calling 800.616.6888.

15 U.S.C. 7704(a)(4) - The Act prohibits the sender, or others acting on the senders behalf, from initiating a commercial email to a recipient more than 10 business days after the recipient has requested not to receive additional emails from the sender,

All USHPA unsubscribe/removal requests are processed the same day whenever possible, and at most within 72 hours, well within the 10 days mandated by law. The staff will respond quickly to unsubscribe/removal requests and consider such requests of a high priority.

15 U.S.C. 7704(a)(5) - The Act prohibits sending a commercial email message without providing three disclosures: (1) clear and conspicuous identification that the message is an advertisement or solicitation, (2) clear and conspicuous notice of the opportunity to decline to receive further commercial email messages from the sender, and (3) a valid physical postal address of the sender.

While USHPA emails are not of a commercial nature, they do indicate they are an official transmission from the Association and their purpose in the opening preamble, as well as a descriptive "opt-out" message, and our full physical mailing address.
